Your privacy is of the utmost importance to us. Below you will find more information about how Onyva handles your data. The fundamental privacy principles used by Onyva are as follows: 

 

Information regarding your activities or other personal information that you upload or publish on Onyva may be seen by others, depending on your privacy settings. 

We group and anonymize certain data of our users to make an overview of the general activity level within the team you registered for or within your organization or company. 

All data we share with your organization or company is completely anonymised and is grouped with data from other users within your organization or company. As such, it is impossible for your organization or company to trace your activity data on an individual level. 

We offer various options to monitor the privacy of your personal information and we always work to expand and improve the privacy options at your disposal. 

 

Onyva respects your privacy and shares your concerns about the security of data that you may be sending to our platform and the associated Onyva mobile applications and services (collectively, the "Services"). This privacy policy (the "Privacy Policy") explains what information we collect, how we use and share it, how you can manage your privacy settings and your rights in connection with the Services. Please also read the Terms of Service where the conditions for the Services are described. 

Onyva is headquartered in Bruges, Belgium and is the administrator of your personal data for the application of EU data protection legislation. 

Unless otherwise stated, this Privacy Policy does not apply to third-party products or services or the practices of companies that we do not own or control, including other companies with which you may communicate on or through the Services. For this we refer to the privacy policy and the terms of service of the relevant companies.

We collect, use, share and process information 

Onyva collects and processes the information that we register via the app for the purposes described in this Privacy Policy and to provide the services described in the Terms of Service. We cannot deliver the Services unless we collect and use your activity data. 

 

Our Legitimate Interests 

We process your data to promote our legitimate interests, including: 

Delivering and improving the Services, including personalized Services. We do this because it is necessary to pursue our legitimate interests in providing and developing innovative and customized offers to our members on a sustainable basis; 

Keeping the Services safe and secure. We do this because it is necessary to protect the legitimate interests of Onyva and its members in ensuring the security of the Services, and to provide protection against fraud, spam and abuse, etc. 

 

Information that Onyva collects 

Onyva collects information about you, including information that identify you directly or indirectly, if you choose to share it with Onyva. We receive information in various ways, including when you upload activities using applications from other companies included in the list of connectable apps and wearables. See also the Services conditions for more information. Onyva also collects information about how you use the Services, how you register in a team, how you relate to other team members in terms of activity level. There are also various options for sharing information about yourself and your activities with Onyva. For example: 

 

We collect basic account information such as your name, e-mail address, date of birth, gender, user name and password that helps with security and gives you access to our Services. 

Profile and usage information is collected about you when you choose to upload or post a photo, activity (including date, time and geolocation information, as well as your speed, pace or average heart rate), add your equipment usage, vieuw activities of others or use the Services in any other way. 

Onyva collects information from wearables and apps that you connect to Onyva. For example, you can pair your Fitbit watch or Runkeeper account with Onyva and information from these wearables and apps will be passed on to Onyva. 

Onyva can collect or derive information, such as heart rate or other biometric information, such as power, cadence, height and weight or other indicators. Before you can upload this information to Onyva, you must explicitly consent to the processing of that information by Onyva. You can withdraw your consent at any time by de-activating your account. 

We collect information from the photos, posts, comments, applauses and other content you share on the Services. 

We collect and process location information when the app or wearable that you connect to Onyva registers this information and when you sign up for and use the Services. 

 

The way Onyva uses information 

Onyva uses the information we collect and receive for the management and operation of the Services and as otherwise described in this Privacy Policy. We use your activity information to calculate the activity points associated with each activity that you upload. Based on these activity points, your 'activity level' is calculated as well as the 'battle points' that you collect during a 'team battle' or 'company battle'. Subject to your privacy settings, your data, including your profile, user name, photos, members you follow and that follow you, teams you are a member of, your activities, activity points, activity level, and applauses and comments that you give and receive, are shared on Onyva to participate in the Services. 

We also use your information to analyze, develop and improve the Services. We may also use your information to enforce our Terms of Service, promote security and communicate with you. In addition, your information may be shared with third parties, as set out below. 

Onyva may de-identify or merge the content that you make available in connection with the Services in a manner that does not personally identify you. Examples of such composite information or statistical data include information about equipment, the overall activity level within your organization or company, the number of team battles, company battles or company goals within your organization or company. Onyva can use, sell, license and share this information with third parties for research, business or other purposes such as calculating changes in activity levels within your organization or company. 

We use your information to communicate with you about the Services or to notify you of new features or updates to our Terms of Service. We also use your information to respond to you when you contact us. Onyva uses your data to communicate with you, for example by sending you notifications. 

 

How information is shared

Subject to your privacy settings, your information and Content may be accessible to other users. 

 

Affiliated parties and transferees of our Company or our Assets 

We may share your information with affiliates under our common management and must comply with the terms of this Privacy Policy regarding your information. If Onyva becomes involved in a business combination, the provision of securities, bankruptcy, reorganization, dissolution or other similar transaction, we may share or transfer your information in connection with such a transaction. 

 

Legal requirements 

We may store and share your information with third parties, such as law enforcement, public or government bodies or private individuals established in or outside your country of residence, if we determine that this is reasonably necessary to comply with legislation, including to respond to a court order, arrest warrant, summons or other legal or regulatory processes. In addition, we may retain or disclose your information if we establish that this is reasonably necessary or appropriate to prevent the death or serious bodily harm of a person, to address issues of national security or other matters of public interest, to prevent or detect violations of our Terms of Service or fraud or abuse of Onyva or its members, or to protect our business or our property or other legal rights, including by disclosing data to our legal advisers and other consultants and third parties in relation to (potential) legal proceedings. 

 

How we protect information 

We take various measures to protect the collection, transfer and storage of the data we collect. While we strive to provide reasonable protection for your information, suitable for its sensitivity, we do not guarantee or provide any guarantee for the security of the information you share with us and we are not responsible for theft, destruction, loss or unintentional disclosure of your information or content. No system is 100% safe. The Services are using the highest standards of security in rest (Transparant Data Encryption) and transit (SSL) 

Disclaimer 

Although Onyva remains committed to protecting your personal information, the security of data transfer via the Internet cannot be 100% guaranteed, and Onyva cannot guarantee the security of information you send to Onyva. The sending of personal information is at your own risk. 

 

Manage your settings 

Privacy settings 

Onyva offers various functions and settings that help you manage your privacy and share your activities. The privacy settings are on your profile page within the onyva application on your mobile device, under settings, privacy settings. Onyva offers you the option to make your activities, activity points, activity level as well as your organization or company and the team within this organization or company of which you are member invisible. This ensures that these data remain protected for other users within Onyva. 

 

Update account information 

You can correct or update any submitted account information that is not correct at any time by modifying that information in your account settings, accessible via your profile page within the onyva application on your mobile device, under settings. If you need more help, please contact Onyva via info@onyva.be. Onyva will generally answer your questions within 7-10 working days. 

 

Delete information and accounts 

You can file a request to have your account removed via info@onyva.beOnce you delete your account, we can no longer follow your activities. 

Please note: Content that you have shared with others or that others have copied may also remain visible after you delete your account or the information from your own profile. 

You have the right to view, correct, download or delete your data, as well as the right to limit certain processing of your data and to object to it. Some of these rights are generally applicable, others only in a limited number of cases. Below we describe these rights:

ComplaintIf you want to ask questions about our use of your information (and without prejudice to other rights that you have), you have the right to do so with your local supervisory authority. 

 

Storing information 

We store information as long as necessary to deliver the Services to you and others, subject to any legal obligations to further store such information. Information relating to your account will generally be retained until it is no longer required to provide the Services or until you ask us to delete it or your account has been removed, if earlier. For example, if you withdraw your consent to the processing of your activity-related information by OnyvaOnyva will delete all activity-related information you upload. After you delete your account, it may take up to 30 days to completely remove your personal data and system logs from our systems. In addition, we may track information from deleted accounts to comply with the law, to prevent fraud, to collect fees, to resolve disputes, to resolve problems, to assist in investigations, to enforce the Terms of Service and to carry out other actions allowed by law. The information we retain will be treated according to this Privacy Policy. 

Information about you that is no longer necessary and relevant to the provision of our Services may be anonymised and aggregated with other non-personal information to obtain insights that are commercially valuable to Onyva, such as statistics on the use of the Services. This information is disconnected from your name and other identifiers. 

 

Information about the Privacy Policy 

Onyva reserves the right to change this Privacy Policy at any time. Please read it occasionally. If Onyva makes changes to this Privacy Policy, the updated Privacy Policy will be posted on the Services in a timely manner and, if we make material changes, we will make a prominent notification and ask you for your approval. If you object to any change to this Privacy Policy, you can stop using the Services and delete your account.
